[Collapse]LicencesFor the purposes of this data collection a HMO means a house in multiple occupation as defined in sections 254 to 259 of the Housing Act 2004, as a building or part of a building which: (i) Meets the standard test; (ii) Meets the self-contained flat test; (iii) Meets the converted building test; (iv) Has an HMO declaration in force; or (v) Is a converted block of flats. Mandatory licensing applies to larger, higher risk HMOs of three storeys or more. Local authorities have the discretion to extend licensing to other categories of HMOs. This enables them to address particular problems that may exist in smaller properties. Additional licensing may apply to those HMOs and geographical areas that the local authority considers appropriate. This is known as additional licensing. Before implementing an additional licensing scheme the local authority must satisfy certain criteria. The Housing Act 2004 introduced selective licensing to deal with particular problems in an area. Selective licensing applies to non-HMOs. Selective licensing will be primarily focused on: (i) areas of low housing demand; (ii) other areas suffering from anti-social behaviour. Some types of buildings are exempt from licensing, these include: (i) properties managed or owned by a public body (such as the police or the NHS), a local authority or a Registered Social Landlord (ii) student halls of residence (iii) buildings entirely occupied by freeholders or long leaseholders. Only HMOs licensed at 31st March are included, not a total of the number of licenses issued during the year. If a Local Authority does not have a selective licensing scheme then a zero will have been recorded in this row. [Filter]

General description

The information presented here covers licences issued by local authorities to residential properties, including Houses in Multiple Occupation (HMOs). HMO licensing was introduced to help ensure that HMOs are well managed. Local authorities are responsible for licensing, which is mandatory for some types of HMO and may be applied to others. Mandatory licensing applies to larger, higher risk HMOs of three storeys or more. Local authorities have the discretion to extend licensing to other categories of HMOs.

The information on HMOs was reviewed during 2009 and following consultation changes were introduced to the data items collected. The number of known HMOs was added following the review and was not previously collected and published.

The information presented here is collected via annual returns from Welsh planning authorities on Hazards & Licences during each year.
